1. Agreement
These Terms are a contract between you and ORVEXIA Technologies LLC ("ORVEXIA") for your use of ORVEXIA ABA Professionals (the "Product"). By creating an account, checking the box or button that refers to these Terms, or using the Product, you agree to them and to the Privacy Policy. If you use the Product for an organization, you confirm that you can bind it, and "you" includes the organization.
2. Eligibility
You must be at least 18 years old to create an account or use the Product. The Product is not offered to minors. You may not use the Product if you are barred from doing so under U.S. law or the laws of your country.
3. Your account
Give accurate information, keep your credentials confidential, turn on two-factor authentication where offered, and tell us at once about unauthorized use. You are responsible for activity under your account. We may refuse a username that impersonates others or infringes rights.
4. License to use the Product
Subject to these Terms, ORVEXIA grants you a limited, revocable, non-exclusive, non-transferable license to use the Product for its intended purpose. You may not copy, modify, resell, reverse engineer (except where the law allows), circumvent technical limits or security, or use the Product to build a competing service. Open-source components are licensed under their own licenses, which prevail for those components.
5. Acceptable use
You agree to follow the Acceptable Use & Community Guidelines. In short: no illegal activity, no harassment or hate, no infringement, no malware or attacks, no spam or fraud, no attempts to access other people's data, and no use that endangers safety.
6. AI features
AI output is generated automatically and may be inaccurate, incomplete or offensive. Review it before relying on it, especially for legal, medical, financial, safety or employment matters. You are responsible for how you use AI output and for having the right to submit any input. You own the output you generate, to the extent the law allows, but similar output may be produced for others. The study assistant uses Google's unpaid Gemini API tier, under which Google may use what you send to improve its products (see the Privacy Policy); do not enter personal, client or health information. The assistant is not offered to users in the European Economic Area, Switzerland or the United Kingdom while we use Google's unpaid tier.
7. Fees and payments
Prices, taxes and billing terms are shown before you pay and are governed by the Purchases & Refund Policy, which is part of these Terms. All purchases are one-time payments that never renew automatically, except the RBT Mock Exam — Monthly plan, which is a subscription: it renews automatically every month at the price shown before you pay until you cancel, and you can cancel anytime online from My purchases, keeping access until the end of the paid month (see the Purchases & Refund Policy, section 2). Payments are processed by Stripe; its terms also apply. You authorize us and our processor to charge the payment method you provide.
8. Product-specific terms
- The Product is not affiliated with, endorsed by or sponsored by the Behavior Analyst Certification Board (BACB). Practice questions are original and are not actual exam items.
- Content is educational only and is not clinical, medical or professional advice. It does not create a provider–client relationship.
- Do not enter protected health information or client-identifying details of real people. ORVEXIA is not a HIPAA covered entity for this Product.
- Purchases grant access for the period stated at checkout; access ends automatically at the end of that period and is not renewed unless you buy again.
9. Pre-release features and changes
Beta, preview or concept features are provided for evaluation, may change or be discontinued, and may contain errors. We may modify the Product. If we discontinue a paid Product, we will give reasonable notice and a pro-rata refund of prepaid fees for the unused period.
10. Third-party services
The Product may link to or integrate third-party services (for example sign-in, payments, maps, AI models or app stores). Their terms and privacy policies govern your use of them, and ORVEXIA is not responsible for them.
11. Intellectual property and feedback
ORVEXIA, the ORVEXIA logo, product names and characters are trademarks of ORVEXIA Technologies LLC. Nothing in these Terms grants you rights in them. If you send us feedback, we may use it without obligation to you.
12. Suspension and termination
You may stop using the Product and delete your account at any time. We may suspend or terminate access if you materially break these Terms, create risk or legal exposure, or if required by law; when practical we will give notice and a chance to fix the issue, and let you export your data. Sections that by nature should survive (ownership, disclaimers, limitation of liability, disputes) survive termination.
13. Disclaimers
TO THE EXTENT PERMITTED BY LAW, THE PRODUCT IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PRODUCT WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE. Some jurisdictions do not allow these exclusions, so some may not apply to you.
14. Limitation of liability
TO THE EXTENT PERMITTED BY LAW, ORVEXIA WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST PROFITS, DATA OR GOODWILL. ORVEXIA'S TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE PRODUCT IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID ORVEXIA FOR THE PRODUCT IN THE 12 MONTHS BEFORE THE CLAIM OR US $100. These limits do not apply to liability that cannot be limited by law, such as for gross negligence, willful misconduct, or death or personal injury caused by our negligence.
15. Indemnity
If you use the Product for business, or if you break these Terms or the law, you will defend and indemnify ORVEXIA against third-party claims arising from that use or breach, including reasonable attorney fees. This section does not apply to consumers where the law prohibits it.
16. Disputes
- Talk to us first. Before filing a claim, send a written notice describing it to admin@orvexiatech.com. We will try to resolve it within 60 days.
- Small claims. Either party may bring an individual claim in a small-claims court (in Texas, a justice court) that has jurisdiction over it.
- Courts. Any other dispute arising from these Terms or the Product will be decided by the courts named under “Governing law and venue”.
- Individual claims. To the extent permitted by law, claims may be brought only on an individual basis, not as a plaintiff or class member in any class, collective or representative proceeding.
17. Governing law and venue
These Terms are governed by the laws of the State of Texas and applicable U.S. federal law, without regard to conflict-of-law rules. Subject to the “Disputes” section, the state and federal courts located in Fort Bend County, Texas have exclusive jurisdiction. If you are a consumer, nothing here removes protections that the law of your place of residence gives you and that cannot be waived by contract.
18. General
These Terms, together with the documents they reference, are the entire agreement about the Product. If a provision is unenforceable, the rest remains in effect. Failure to enforce is not a waiver. You may not assign these Terms without our consent; we may assign them in a merger or sale. We will give at least 30 days' notice of material changes; continuing to use the Product after they take effect means you accept them, and if you do not agree you may cancel. You must comply with U.S. export and sanctions laws.
